Failure to Provide Proof of Contact or Documentation
*** In response to Clarity... Clarity can respond every day, but the facts remain: I have received neither documentation showing contact with Wyndham or Legacy South Mountain nor a refund of my $3,187. I have been waiting five months for that documentation. What is so difficult to provide? Unless of course, in accordance with two major companies, Legacy South Mountain nor Wyndham were never contacted. A certificate supplied by Clarity is not proof that the resort released me from ownership or financial obligations. Au contraire, Pinnacle’s written response states that Legacy still considers me the owner and has no record of third-party involvement or an ownership transfer. According to Pinnacle, neither Wyndham nor Legacy works with third-party exit companies. Clarity has yet to explain this contradiction or provide evidence that the resort accepted my termination. In January 2026, Matt Madlinger personally advised me not to pay my resort dues, telling me the bill was an error. Clarity supplied a certificate stating that my timeshare was canceled, yet Legacy’s position, as communicated by Pinnacle, directly contradicts that claim. The unpaid charges subsequently went into collections. Offering credit repair does not resolve this failure. My requested resolution is straightforward: refund my $3,187 and pay the resulting Pinnacle charges. Clarity’s advertised 100% money-back guarantee remains unfulfilled in my case. I will continue pursuing my complaints with the appropriate government agencies and requesting an investigation. **See below for history.. On February 4, 2025, I paid Clarity Closings $3,187.00 to terminate my paid-in-full ownership in Legacy South Mountain Golf Resort and release me from related obligations. Clarity instructed me not to pay resort invoices or contact the resort or debt collector about the termination. Clarity said my account was canceled by Legacy and provided a certificate of closure dated November 26, 2025. Six months later a debt collector hired by the time share company, Pinnacle Recovery, began demanding unpaid resort charges in May 2026. Clarity was notified and insisted I do nothing. Its August 4 letter said Legacy still considered me the owner and had no record that I worked with a third party or that ownership had been transferred. Pinnacle demanded $2,280.10 in August. The balance claimed is now $2,293.13, including added charges on an original bill of about $1,563. My credit has also been harmed. I repeatedly asked Clarity for proof of its contacts with Legacy, Wyndham, or Pinnacle and proof that my ownership and obligations ended. It provided none and stopped responding. The agreement’s maximum twelve-month period has passed, and Clarity refused my refund request. I request that Clarity pay me $5,480.13 directly: a $3,187.00 refund plus $2,293.13 for the balance now claimed by Pinnacle. I will address Pinnacle separately. I also request a written account of the work Clarity performed, whom it contacted and when, and why it issued the closure certificate. ** To date, Despite my repeated requests, Clarity Closings has provided no documentation showing that it ever contacted Legacy South Mountain Golf Resort, Wyndham, or Pinnacle concerning my termination. I am turning this case over to the authorities.

Roslyn, we understand your concern about receiving collection notices after being advised that your ownership was closed however this is now the third negative review you have published about the same matter across two platforms that we have addressed. We respectfully dispute several statements while recognizing that the underlying concerns deserve a substantive response. We dispute that our team instructed you to stop paying resort invoices regarding maintenance fees. Your signed agreement expressly requires owners to keep fees and applicable payments current during the termination process. Regarding the closure notice, our records reflect that you informed our team the ownership was already closed while proposed closing terms were still being finalized. The team attempted to establish the basis for that statement but did not obtain supporting resort documentation. Our notice reflected the team’s understanding at that time. It is a company-issued document, which differs from independent confirmation from the resort. Our closing team subsequently concluded that direct communications with the resort affected its ability to continue through the proposed closing route. That remains the team’s assessment and a disputed part of this matter. Our position against a refund rests on the service history and our interpretation of the agreement’s cooperation requirements alongside its timeline and refund provisions. Our standard communication policy provides client updates through the client portal rather than distributing internal correspondence among our staff, resort representatives, or related third parties. The portal provides an ongoing record of case updates and progress so clients can follow the process. We remain available to explain the work performed, the basis for the closure notice, and the supporting documentation available to us through a private channel. The limited credit checks previously reviewed with you did not identify related adverse reporting. **However if you have a credit report or other supporting evidence showing adverse reporting related to the past-due maintenance fees, we encourage you to send it to us privately so we can review and address it.** Credit-restoration enrollment remains available at **no additional charge**, with your cooperation and the documentation and authorizations reasonably needed to provide assistance. The reported obstacle to further closing work does not prevent you from receiving that support. Please contact [email protected] so these matters can be addressed directly. We stand behind our continuing service commitment and will cooperate with the appropriate authorities reviewing your complaint.
